This Site and all its content and services are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied. InvestLibya expressly disclaims all warranties, including specifically:

• Implied warranties of merchantability or fitness for a particular purpose
• Warranties of non-infringement of intellectual property rights
• Warranties of the Site's continuous availability, uninterrupted access, or freedom from errors
• Warranties of the accuracy, completeness, or currency of any content

Some jurisdictions do not permit the exclusion of implied warranties, and as a result some of the above exclusions may not apply to your situation.

To the fullest extent permitted by applicable law, InvestLibya, its employees, officers, agents, and affiliates shall not be liable for any of the following:

These limitations apply even if the Authority has been previously advised of the possibility of such damages, regardless of the legal theory relied upon (contract, tort, strict liability, or otherwise). Nothing in these provisions excludes liability arising from fraud or gross negligence where the law prohibits such exclusion.

These Terms & Conditions and any dispute arising therefrom or in connection with the use of the Site shall be governed by and construed in accordance with the laws of the State of Libya, without regard to any conflict of law rules.

By using the Site, you agree to submit to the exclusive jurisdiction of the competent Libyan courts in Tripoli for the resolution of any dispute arising from these Terms or your use of the Site.

The relevant Libyan legislation governing the use of this Site specifically includes: Law No. 9 of 2010 on Investment, Law No. 5 of 2022 on Personal Data Protection, the Libyan Commercial Transactions Law, and other applicable laws and regulations.

In the event of any dispute regarding these Terms or use of the Site, InvestLibya adopts the following graduated procedure:

• Step 1 — Amicable Resolution: The User is first directed to raise their dispute in writing via email to info@investlibya.ly, and InvestLibya will endeavour to reach an amicable resolution within 30 business days of receipt of the notice.
• Step 2 — Mediation: If the dispute is not resolved amicably, either party may seek mediation under applicable Libyan regulatory frameworks.
• Step 3 — Litigation: If mediation fails, the dispute shall be referred to the competent Libyan courts pursuant to Article 16 above.

InvestLibya reserves the right to amend, update, or replace these Terms & Conditions at any time by publishing the updated version on the Site with an updated "Last Amended" date. Prior notice of amendments is not required, although material amendments will be prominently announced on the Site. Your continued use of the Site after publication of any amendment constitutes your explicit acceptance of the amended Terms.

Severability: If any provision of these Terms is found to be invalid, unenforceable, or contrary to law under any jurisdiction, that provision shall be severed from and disregarded without affecting the validity or enforceability of the remaining provisions.

Entire Agreement: These Terms & Conditions, read together with the Privacy Policy, constitute the entire agreement between the User and InvestLibya with respect to the use of the Site, and supersede all prior agreements, understandings, and representations relating to the subject matter, whether oral or written.

Waiver: InvestLibya's failure to exercise or delay in exercising any right or power granted under these Terms shall not constitute a waiver of that right or power.
